‘Helpers’ gang-rape teenager during sanitation in Ogun

The Ogun State Police Command has arrested two men for allegedly gang-raping a 14-year-old girl in Obantoko, in the Odeda Local Government Area of the state.

The suspects are Abiodun Ishola and Kehinde Oloyede.
The state Police Public Relations Officer, Abimbola Oyeyemi, said they were arrested on Saturday, April 28, 2018, following a complaint from the victim.
The victim, who is a hairdresser, had reported at the Obantoko division how the suspects allegedly raped her on the sanitation day.
Oyeyemi said during the exercise, the victim was on the way to her workplace, unknown to her that sanitation was still on.
He said, “She said further that Abiodun, who was sitting in front of his father’s house, informed her of the restriction of movement and asked her to stay in the house pending when the exercise would end.
“While she was with Abiodun, the victim said he took her bag inside the room and when she wanted to leave, he told her to go to pick her bag, not knowing that he (Abiodun) had sent for his friend, Kehinde, who later joined him. They both forcefully had carnal knowledge of her.
“It was her screams that attracted people who eventually rescued her.”
He said the Divisional Police Officer, Obantoko division, Veronica Osakwe, later led detectives to the scene where Abiodun was apprehended and his arrest led to the eventual arrest of his accomplice, Kehinde.
He said on interrogation, the suspects confessed to the crime.
The victim was reportedly  taken to a hospital for medical examination.
“The state Commissioner of Police, Ahmed Iliyasu, has ordered that the  suspects should be transferred to the Anti-Human Trafficking and Child Labour Unit of the State Criminal Investigation and Intelligence Department for further investigation and prosecution,” Oyeyemi added.

In another development, a police inspector, Azeez Ajasa, of Mopol 16, Oke Ilewo, Abeokuta, died in a lone accident on Tuesday at Sowo village along the Abeokuta-Kobape-Sagamu Expressway.
The Public Relations Officer, Ogun State Traffic Compliance and Enforcement Corps, Babatunde Akinbiyi, said the deceased was travelling in a golf car with the number plate, EKY 631 BB, from Abeokuta to Iperu, when he lost control of the vehicle due to speeding.
The golf was said to have somersaulted and landed into a bush.
Akinbiyi said the victim’s corpse had been deposited in the mortuary of the Ijaiye General Hospital, Abeokuta.

President Muhammadu Buhari has said that most youths from the northern part of the country are either uneducated or school dropouts.

He also said God would judge past leaders who misgoverned the country.
Buhari said because Nigerian media only do what they like, they refused to highlight the explanations in his recent statement in which he was widely quoted as describing a lot of Nigerian youths as lazy.
The President said this in an interview he had with the Voice of America, Hausa service, in Washington, United States on Tuesday.
When asked about his reported comment on Nigerian youths while in London for the Commonwealth Heads of Government Meeting, Buhari said the media only preferred to report what they like instead of concentrating on developmental journalism.
The President said, “You know they say we are between 180 and 200 million people in Nigeria and 60 per cent are the youths below the age of 30.
“In the North for instance, most have not attended school or they abandoned halfway.
“If not because we had favourable rainfall in the past two seasons, most of them have no job, just idling away.
“People like them, even if they go to the South for instance, what they will make will not be enough to even pay their rent let alone feeding, clothing and transport back home.
“That has not been explained enough and you know the media, especially the print, are simply doing whatever they like.

“We had two successful farming seasons, people went to farm and did very well, but no one is talking about that; only insults.
“That is why the Minister of Information, Lai Mohammed, had to respond to the letter of insults released by (former President Olusegun) Obasanjo. We spoke about it and I asked him not to respond but he refused and said he would just respond by stating the situation we met the country, where it is now and what has been done in-between and the monies we are getting.”
Buhari restated his position that the Peoples Democratic Party, in its 16 years in power, left debts for the country despite making huge income from oil.
He said there were no good roads or power supply to justify billions of dollars spent, adding that only God would judge the past leaders.
“Recently, I had to come out and state that from 1999 to 2014, anyone who carries out a study here in America or Europe or India will know that we were producing 2.2 million barrels of crude oil daily at a price of at least $100 per barrel.
“In those 16 years of the PDP rule, Nigeria was getting 2.1 million x $100 every day, every week, but when we came on board; the price fell to between $37 and $38 and hanged around $40 and $50.
“I went to the CBN – the governor of CBN is here and asked him how far and he said nothing was left apart from debts.
“I said but this is what the country made? And he said yes, he knew, and I asked him where is the money? All is gone.
“Nigerians know that there were no roads or rail lines, there was no power, despite the billions of dollars spent. Only God will judge this thing,” the President declared.
Buhari insisted that conflicts between farmers and herdsmen did not start now, adding that it was wrong to describe it as clashes between Fulani and other people.
As part of efforts to restore security in parts of the country, Buhari said he had approved the recruitment of additional 6,000 policemen for the country.

He said his directive was that the personnel should be recruited across the 774 local government areas in the country instead of “going to motor parks and markets to just pick people anyhow.”
Buhari also kicked against the establishment of state police as being canvassed by some people including state governors.

A former inmate of the Kirikiri Maximum Prison, Jide Odusanya, has asked people to control their tempers, saying anger landed him in prison.

The Sagamu, Ogun State indigene, who spent 26 years in three different prisons in the country before he was pardoned by the Lagos State Government, said a fight over water spillage destroyed his dream of becoming a bank manager.
He spoke on Tuesday at a conference organised by the Prison and Hospital Ministry of the Redeemed Christian Church of God at the Ogun Province 4 Headquarters, Redemption Camp, Ogun State.
Odusanya had testified along with two others at the event, tagged, ‘From Hopelessness to Glory,’ saying he was sentenced to death for a crime he did not commit.
The 57-year-old, who is unmarried, said his ordeal started in June 1991 when he fought a mechanic in the Ebute-Meta area of Lagos State where he lived with his parents.
He said, “The mechanic usually came to fetch water in my father’s house and I told him to always lock the tap when he was done. This was because my room’s window was close to the tap and when water spilled on the floor, it bred mosquitoes which entered my room.
“But that day, he asked why I would talk to him in such a manner. He pushed me. I was angry and slapped him, which started a fight. The younger brother of one of my friends came to visit me that period.
“Instead of separating the fight, the boy took a flaming wood and smashed it on the mechanic’s head. The mechanic hit his head on the ground and sustained some injuries. The boy and I were arrested and detained at the Iponri Police Station for causing grievous bodily harm.
“The injured mechanic’s uncle, who was an army officer, said he was interested in the case. It was during the military regime. We were transferred to the State Criminal Investigation and Intelligence Department, Yaba.”

Odusanya said at the SCIID, the police changed the case to armed robbery after the Investigating Police Officer visited his house and found a knife which he used to cut loaves of bread.
He noted that he and the co-accused were arraigned for armed robbery in a magistrate court and were remanded in the Ikoyi Prison, where they spent seven years without trial.
“After seven years, legal advice said I had a case to answer, while the boy was discharged and acquitted. I was moved from the Ikoyi Prison to the Kirikiri Maximum Prison.
“I was taken to a court at Igbosere where I was sentenced to death based on the knife evidence. I was on death row for three years before former Lagos Governor, Bola Tinubu, converted it to life imprisonment on December 31, 2001.
“I spent 16 years in life imprisonment. At some points, I was taken to the Ibara Prison in Ogun State and would have been released by the then Governor of the state, Gbenga Daniel, who asked to see my file. But the prison authorities did not send the file to him.
“After eight years at Ibara Prison, I was returned to the Kirikiri Prison. I was considered for pardon by the Lagos State Government and was released in June 2017,” he added.
Odusanya said upon his release, he met his nurse girlfriend, whom he was engaged to before the incident, adding that she was already married with five children.
He noted that his father and mother died while he was in prison.
He said during counselling, some church workers assisted him to connect with a relative who worked with the Nigerian Railway Corporation, adding that the relative thought he (Odusanya) was dead.
The ex-convict lamented the condition of Nigerian prisons, saying many inmates became hardened after going through the system.
“The prisons are not reforming anybody. Those who make the difference in our prisons are the non-governmental organisations and churches. Anybody that comes out of prison and changes, God must have been involved. Most often, criminals become hardened after passing through the prison.
“I became a born-again Christian in prison due to the visitations of some churches like the Mountain of Fire and Miracle Ministries, led by Dr D.K. Olukoya; Pastor Tunde Bakare’s Latter Rain Assembly and the Redeemed Christian Church of God. Pastor E.A. Adeboye’s visits to prisons every two years and his ministrations give people like us hope.

“I made my O’level credits in prison and gained admission into the National Open University of Nigeria where I started studying Cooperative Management. I am now in 200 level. The challenge I have is that after I was released from prison, the school withdrew a scholarship it gave me. I have been running around to raise the school fees of N50,500 to no avail,” he added.
Odusanya urged Nigerians to refrain from arguments that could make them misbehave, adding that he also believed that some malevolent forces might have had a hand in his ordeal.
Asked his plans about marriage, he said he was not bothered because he believed God had plans for everyone.
The Chairman of the RCCG Prison and Hospital Ministry, Pastor Ariyo Popoola, appealed to the government to provide conducive environment for the youths to thrive and increase employment opportunities to reduce crime in the country.
He also urged young people to take advantage of various empowerment programmes to become responsible members of society.
The Lagos State Commissioner of Police, Edgal Imohimi, who was represented at the event by the state Police Public Relations Officer, SP Chike Oti, in a presentation, asked Nigerians to always be security conscious and avoid giving out too much personal information on the social media.

Britain’s Queen Elizabeth flew in by helicopter to London to meet Prince Louis, fifth-in-line to the British throne and the latest member of Britain’s royal family.
Prince Louis, the third child of Prince William and his wife Kate, was born on April 23.
On Tuesday, the queen, 92, arrived at Kensington Palace, William and Kate’s London home, from Windsor Castle to the west of London, where her 96-year-old husband is recuperating after a hip operation.
Earlier William and Kate formally registered the birth of Louis, who joins brother George, 4, and sister Charlotte, 2.
“The Duke and Duchess of Cambridge are delighted to announce that they have named their son Louis Arthur Charles,” said a palace statement.
“The baby will be known as His Royal Highness Prince Louis of Cambridge.”
The name pays tribute to William’s great-great uncle Louis Mountbatten, who was killed by the IRA in 1979, while Charles is the name of William’s father.
Arthur had been the bookmakers’ favourite for the couple’s third child.
Louis is currently the 71st most popular name for a baby boy in England and Wales.
Their two other children — Prince George, aged four, and two-year-old Princess Charlotte — had met the latest addition to the family earlier in the afternoon, before returning home to Kensington Palace.
He will hold the title of the prince after the Queen changed the rules in 2012 to ensure that all of William’s children would be entitled to the style, not just his eldest son.
Prince Louis is also the first male royal who will not overtake his sister in the line of succession after a reform that ends male primogeniture.

An Austrian man with a violent criminal past on Wednesday admitted to killing a woman, dumping her body in a lake and keeping one body part for “tasting,” a prosecution spokeswoman said.
The case came to light in mid-April when a fisherman found the woman’s torso floating in Lake Neusiedl near
Rust, a town east of Vienna.
The suspect told police that he killed the woman in the heat of an argument in his flat and cut up her body for disposal in late March, less than two years after he was released on probation from an institution for mentally disturbed convicts.
The man, who was born in 1955, had a violent and sexual criminal history, prosecution spokeswoman Verena Strnad
told a press conference in Eisenstadt.
Police are still trying to identify the woman, who was between 25 and 30 years old.
Police investigator Harald Brenner said he could not rule out that she was from Slovakia.
Investigators said the man got to know the woman near Vienna’s Westbahnof train station, and that she possibly
did not give him her real first name.
“He cut her up into several parts and dumped them in the bay” of the lake, Strnad said.
After the parts were discovered, investigators found one fishing hut in the lake owned by a previous convict.
His apartment did not only contain DNA traces of the victim but a cut-up body part in the freezer.
“He said he had considered tasting it at a later point in time,” Strnad said.

A Man identified as Columbus Chijoko, after being granted a protection order against his wife whom he accused of taking his underwear to prophets and threatening to poison him.
He told Civil Court magistrate Lazini Ncube last week that he was now even scared to eat at home because of the threats by his wife, Alice Takawira.
Chijoko said his wife was also in the habit of harassing him at his workplace and assaulting him in front of their children.
However, Alice Takawira told a different story to the court, she claimed her husband applied for the protection order to stop her from questioning him about an alleged extra-marital affair.
She claimed she was tipped off by Chijoko’s workmates that he was having an affair with a colleague.

Dr. Emeka Obi, a dietician in Abuja, has said that the high level of “B vitamins’’ in energy drinks can be very toxic to the human liver.
Speaking with the News Agency of Nigeria on Wednesday in Abuja, Obi, therefore, advised Nigerians to be cautious with the consumption of such drinks.
“Energy drinks like `Monster’, `Red Bull’ and ‘Lucozade Sports’ can be extremely helpful when the body is low on sugar level and energy.
“That is why we see so many athletes drinking them; it gives a boost of energy when you want to exercise, especially when you want to partake in cardiovascular activities.
“The problem is that we see many people being brought to the hospital because of liver poisoning due to abuse of the drinks.
“Energy drinks contain a lot of Vitamin B3 and B6.
“An excessive amount of B3 can cause flushing of the skin and liver toxicity while excess B6 can cause sensory nerve problems and skin bruising.
“I remember there was an incident in the UK last year where a man drank five energy drinks a day for three weeks and ended up getting hepatitis.’’
According to him, there are other possible side effects from the level of caffeine, Glucuronolactone, sugar and other components of the drink.
He, therefore, stressed that the best drink to have is water.

Jupp Heynckes bowed out with Bayern Munich in the Champions League semi-finals with the head coach admitting not many 72-year-olds get to experience “such an adventure”.

Heynckes, who turns 73 next Wednesday, took charge of his final European match in Tuesday’s 2-2 draw at Real Madrid before he steps down at the end of the season.
“Of course I know now, it’s final that I’ll never go back to the bench in a Champions League game – and I think that’s a good thing,” he said as Bayern bowed out 4-3 on aggregate.
“Not many people get to go on such an adventure at the age of 72.
“I don’t feel the emotion ‘yes, now it’s over’, I’m just disappointed with the result, especially for the players.
“I have to compliment my team, I have not seen FC Bayern in form like that for many years, it was football at its best.”
When Carlo Ancelotti was sacked last October, Heynckes returned to Bayern after four years in retirement since leading Bayern to the 2013 treble of Champions League, Bundesliga and German Cup titles.
He only signed a contract until June and Heynckes will be replaced by Eintracht Frankfurt boss Niko Kovac next season.
His Bayern team went down fighting in Madrid.
After losing the first leg 2-1 in Munich, Bayern flew out of the blocks in the return at the Santiago Bernabeu with Joshua Kimmich scoring after just three minutes.
Real equalised when Karim Benzema was allowed to head home unmarked at the far post.
Then a double mistake in the Bayern defence allowed the French striker to make it 2-1 just a minute after the break.

“Sven had a great season,” Heynckes said of Manuel Neuer’s stand-in since September, “he just had a blackout.

James Rodriguez equalised for Bayern, but the Germans ultimately bowed out to Spanish opposition for the fifth season in a row in the knock-out stages of Europe.
Nevertheless, Heynckes has worked wonders with Bayern this season.
Bayern had a five-point deficit in the Bundesliga table when he arrived, yet now hold into a massive 24-point lead after wrapping up a sixth straight title last month.
Bayern’s dreams of winning the treble this season ended in Madrid.
However, they can still do the double as the Bundesliga winners face Frankfurt and their future coach Kovac in the German Cup final on May 19 in Berlin.
Heynckes says he has simply enjoyed working with Bayern’s stars.
“We have had a wonderful atmosphere, a great collaboration over the nine months, it’s a group that has character, it’s a pity it was not rewarded,” he added.
Bayern’s sports director Hasan Salihamidzic poured praise on Heynckes.
“You have to see where we’ve come from, we were written off in October, so I have to give Jupp Heynckes a lot of praise,”said Salihamidzic.

charged for laundering N4.6 billion  at a Federal High Court, Lagos.
Danjuma, who is charged alongside with the ministers, is said to be hospitalised in Kaduna.
Danjuma, a former Chairman of the Association of Local Governments of Nigeria, the two ex-ministers; Femi
Fani-Kayode (Aviation) and Nenadi Usman (Finance) — and a company, Jointrust Dimentions Nigeria Ltd, are on a 17-count bordering on money laundering.
All the defendants, who are being prosecuted by the Economic and Financial Crimes Commission, had pleaded not guilty.
The case which was scheduled for continuation of cross-examination of a prosecution witness could not go on  because fo the absence of the third accused.
When the case was called on Wednesday, Mr Nnemeka Omewa, announced appearance for the EFCC, while Messrs Abiodun Owonikoko (SAN), Norrisson Quakers (SAN) and K.C Nwofo, appeared for the first, second and third accused respectively.
The third defence counsel informed the court of the absence of the third accused.
Nwofo told the court that he received a call in the early hours of yesterday (Tuesday) from the wife of the third accused, who informed him that the accused slumped in the bathroom while having a shower.
He said the wife had called out neighbours who joined in taking the accused to the hospital.
According to defence counsel, the incident occurred in Jere in Kaduna.
Nwofo told the court that since he is yet to get a copy of the hospital diagnosis, he could not comment on the exact health condition of the accused.
He promised to get details of the diagnosis from the hospital and make same available to the court.
Other defence counsel acceded to the request for adjournment by the third defence counsel.
In his reaction, the prosecutor, (Omewa), confirmed to the court, the position as stated by defence counsel.
He said the case was slated for a continuation of cross-examination, adding that since the request for adjournment was on health grounds, especially as put forward by the counsel, he would not push further.
Omewa also agreed with the request for adjournment.
In his remarks, Justice Rilwan Aikawa noted that generally, all the defendants had always been present in court for trial, adding that he will treat the excuse as exceptional.
Following the agreement of all counsel in the case, the court adjourned the case until June 11 and June 12 for a continuation of the trial, while he vacated the prior dates of May 3 and May 4.
The accused were alleged to have committed the offences between January and March 2015.
On counts one to seven, they were alleged to have unlawfully retained over N3.8 billion which they reasonably ought to have known formed part of the proceeds of an unlawful act of stealing and corruption.
On counts eight to 14, the accused were alleged to have unlawfully used over N970 million which they reasonably ought to have known formed part of an unlawful act of corruption.
Similarly, Fani-Kayode and a man, Olubode Oke, who is said to be at large, were alleged to have made cash payments of about N30 million in excess of the amount allowed by law without going through a financial institution.
Besides, Fani-Kayode was alleged to have made payments to one Paste Poster Co (PPC) of No. 125, Lewis Street, Lagos, in excess of amounts allowed by law.
All the offences contravened the provisions of sections 15 (3) (4), 16 (2) (b), and 16 (5) of the Money laundering (prohibition) (Amendment) Act, 2012.

The internationally backed Government of National Accord (GNA) said it was dealing with “the consequences of the cowardly suicide attack” after the health ministry put the toll at 11 dead and two wounded.
Eyewitnesses earlier said shots were heard and black smoke could be seen rising from the headquarters of the national election commission.
The United Nations mission in Libya condemned the “terrorist attack” and said it extended “its condolences to the families of the victims who lost their lives”.
“Such terrorist attacks will not deter Libyans from moving forward in the process of consolidating national unity and building the state of law and institutions,” it said on Twitter.
The UN is hoping that Libya can hold elections this year as it seeks to leave behind years of chaos since the 2011 ouster of dictator Moamer Kadhafi.
UN special envoy Ghassan Salame said in February he was aiming for parliamentary and presidential elections in the North African country by the end of 2018, but warned conditions were not yet ready for polling.
The electoral commission is considered to be one of the few credible and independent institutions in the country.
Elections were banned during Kadhafi’s 42-rule and after his ousting legislative polls were organised in 2012 and 2014.
But turmoil has continued in Libya with rival militias, tribes and jihadists vying for territory and the country’s vast oil wealth.
A 2015 UN-backed deal to set up the GNA in Tripoli failed to end the turmoil, as divisions continue with a rival administration in the east.
Human Rights Watch warned in March the country was far from ready in political, judicial or security terms for elections, citing harassment of activists and journalists as among the problems to be overcome.

A new constitution has to be put to a referendum and an electoral law adopted before polling.
As of March, 2.4 million Libyan voters had been registered of a population of six million.
While most recent attacks across Libya have been outside Tripoli, the capital remains mired by insecurity.
In January clashes between rival militias around the city’s only working international airport left some 20 people dead.
In 2015 the Islamic State group claimed an attack on Tripoli’s luxury Corinthia Hotel that killed nine people, including five foreigners.

Communal clash: Police arrest 11 suspects in Niger

The Niger State Police Command on Wednesday confirmed the arrest of 11 suspects in the recent Katcha/Kpata Kacha bloody communal clash in Mokwa Local Government Area of the state.
The state Commissioner of Police, Mr. Dibal Yakadi, confirmed the arrest in an interview with the News Agency of Nigeria in Minna on Wednesday.
Yakadi said that a fight between two brothers from the two different communities snowballed into a full blown communal crisis, leaving one dead.
He explained that the quarrel was over a long-standing ownership dispute of a parcel of land.
The police commissioner told NAN that the command had deployed 70 policemen to restore peace and normalcy in the communities.
He appealed to residents to assist the police with further information that would help determine immediate and remote causes of the incident with a view to nipping future crises in the bud.

My wife once added rat poison to my meal, man tells court

Nazira Ahmad, a housewife, on Wednesday asked the Sharia Court  I at Magajin Gari, Kaduna to dissolve her marriage with one Sirajo Abdullahi over lack of care and trust.
The complainant told the court that her husband had accused her of adding rat poison to his food and had assaulted her severally.
Ahmad who complained of being neglected by her husband for three weeks after she had left her matrimonial home to her parent’s house, urged the court to dissolve their marriage.
“Abdullah had stopped taking care of me and my child, he no longer provides food and our health isn’t important to him.
“I want this honourable court to compel my husband to divorce me as he is no longer interested in me and I have no peace of mind anymore”, she added.
The defendant, however, disagreed with her claim of not taken care of her, saying that he always provide food and medical care and does not assault his wife.
He revealed that she had once added rat poison to his meal which he never took, adding that he had suspected her of having extramarital affairs.
“There was a day I woke up from sleep and couldn’t find my wife, I waited till 12:00 am before she returned, she lied to me that she had gone to meet her brother,” he said.
Abdullahi added that he still loves his wife and wouldn’t want to divorce her and prayed the court to give him more time to settle with his wife.
The judge, Malam Dahiru Lawal, after listening to both parties, gave the couple up to May 9, to settle their differences.

Britain’s Prince Harry and Meghan Markle will ride in an open-top horse-drawn carriage through the streets of Windsor after their wedding later this month, Kensington Palace announced on Wednesday.

The pair have chosen the Ascot Landau carriage for their procession through the town on May 19, their official London residence said in a statement.
“Prince Harry and Ms. Markle are very much looking forward to this short journey which they hope will allow them to express their gratitude for everyone who has gathered together in Windsor to enjoy the atmosphere of this special day,” the statement said.
The carriage will be drawn by four Windsor Grey horses — Milford Haven, Storm, Plymouth and Tyrone — and accompanied by a travelling escort of the Household Cavalry Mounted Regiment as it departs St George’s Chapel before touring a circuit of the town.
The carriage is one of five Ascot Landaus in the palace collection, which are used by Queen Elizabeth II for her procession at the Royal Ascot horse race.
Two featured in the 2011 wedding procession of Prince William and Catherine Middleton, also carrying best man Prince Harry, the maid of honour, bridesmaids and pageboys from Westminster Abbey to Buckingham Palace.

Darren Martin, a former staff member of former US president, Barack Obama, had the police called on him while moving into his new apartment by neighbours who thought he was a burglar.
Martin took to his Twitter handle to share the incident with the hashtag, #MovingWhileBlack.
Martin, who was a former associate director at the Federal Office of Legislative Affairs in DC and now special assistant to the Commissioner for the New York City Department of Social Services, said he was unloading his belongings at his fifth floor walk-up building on West 106th Street near Manhattan Avenue on Friday night when he saw a marked NYPD car pull up.
“Three officers hop out, demand I let them in the building, and proceed to question me,” Martin wrote in a series of tweets titled #MovingWhileBlack.
“I live here, and I’m moving,’ was my message, but it didn’t permeate.”
At least three more officers, in plainclothes, then showed up, he said.

$496m aircraft purchase: Senators demand Buhari’s impeachment, Reps undecided

Some senators at the plenary on Thursday, called for the impeachment of President Muhammadu Buhari for allowing the withdrawal of $496m from the Excess Crude Account to purchase military aircraft without National Assembly’s approval.
Most of the lawmakers, who spoke on the withdrawal and spending pointed out that the President had breached Section 80 of the 1999 Constitution, while a few disagreed.
The 12 Super Tucano aircraft ordered from the United States would be delivered in 2020.
The Senate President, Bukola Saraki, had on Wednesday read a letter from Buhari in which he admitted that the money had been withdrawn and paid to the US ahead of the legislative approval. This, he said, was done to beat the deadline for the arms deal.
On Tuesday, the letter was slated for consideration and referral to the relevant committee but Senator Mathew Uroghide, who had protested against the expenditure on Wednesday, moved a motion for Buhari’s impeachment for violation of the constitution.
Uroghide, who is the Chairman of the Committee on Public Accounts, specifically urged Saraki to allow the Senate to invoke Section 143 of the Constitution against the President.
He said, “Any amount of money that has to be spent from the Federation Account, must be appropriated by the National Assembly. This one has not been appropriated by the National Assembly and therefore breaches the provisions of the constitution.
“The Senate is not unmindful of the fact that the objective of this expenditure has been well established, but the procedure for this expenditure is wrong. There ought to have been appropriation before this money was spent.”
Uroghide added, “There are serious consequences for the violation of our constitution. As a consequence, the only thing that we can draw from on this is that, we call on you (Saraki) to invoke Section 143 of the Constitution. What it means is that this matter does not need to be investigated; it is clear that this offence has been committed by Mr. President.”
Seconding the motion, Senator Chukwuka Utazi stated that it was time for the legislature to be decisive. He noted that Sections 80 and 81 of the constitution stated the powers of the legislature on spending by the executive and how the executive should manage its finances.
Utazi added, “There is no other name to call this except an impeachable offence and we cannot allow that. We cannot stay here and this Assembly and Nigerians will be taken for granted. It should not be so. I rise and support the motion.”
Also speaking, Senator Shehu Sani has described the expenditure as “a gross abuse of the constitution.”
While Sani stated that he was not in support of the impeachment call, he asked that the payment be refunded and the transaction be started afresh to allow due process.
But Senator Abu Ibrahim described the impeachment call as “a PDP conspiracy.” Ibrahim challenged the opposition lawmakers to name any state governor in the PDP who benefited from the previous withdrawals from the ECA and sought the approval of the state House of Assembly before spending the money.
Senator Samuel Anyanwu, however, countered Ibrahim, stating that the matter was about respect for government’s institutions and not about party politics.
The Deputy Majority Leader, Senator Bala Ibn Na’Allah, however, argued that the executive might have considered Section 83(1-2) of the constitution, which allows the President to make extra-budgetary spending in an emergency situation.
N’allah said, “In view of the controversy that this has generated, my advice is that since we have the Committee on Judiciary, Human Rights and Legal Matters, issues of this nature can be referred to that committee. Let them look at it properly and advise the Senate on the way forward.”
Saraki, in his ruling, noted there were two issues: the spate of insecurity and the flawed process through which the government wanted to tackle it.
The Senate President sought the  permission of the lawmakers to refer the probe to the Committee, which was unanimously granted.
But the House of Representatives was undecided on Thursday whether to approve a $496.3m  request by President Buhari to purchase 12 units of Tucano aircraft from the US.
The House referred the request to its Committee on Rules/Business to look into it and guide the members properly on the way forward.
The House, in keeping with its Tuesday resolution to debate the matter before taking a stance, had listed it on Thursday.
But, as the Speaker, Mr. Yakubu Dogara, called on the Acting Leader of the House, Mr. Mohammed Monguno, to move a motion for the debate, some members kicked against it.
The motion sought to include the $496.3m in the 2018 Appropriation Bill still pending before the National Assembly.
It was the Chairman, Committee on Ethics/Privileges, Mr. Nicholas Ossai, who raised a point of order to observe that by the procedure of the House, the request was belated because Buhari had already spent the money.
Ossai quoted Section 80 (2) of the 1999 Constitution (as amended) to remind members that no funds could be withdrawn from the Consolidated Revenue Fund of the Federation, “except in the manner approved by the National Assembly.”
He argued, “This motion is not relevant because this money has been spent. This matter cannot be discussed at all. This matter ought to have been thrown away and I urge the House that this motion should be withdrawn.”
However, there were other members, who attempted to protest loudly, saying that the House should at least debate the letter and either approve or reject it.
For instance, the Chief Whip of the House, Mr. Alhassan Ado-Doguwa, observed that the House would still be in order by debating the motion.
Some members like the Deputy Minority Leader, Mr. Chukwuka Onyema; Mr. Gabriel Onyenwife; Mr. Agbedi Fredie; and Mr. Sergious Ose-Ogun, backed Ossai.
They said the request was “belated” and trying to bend the House rules to accommodate the $496.3m either by a motion or a fresh money bill, would amount to self-indictment by the legislature.
The Speaker, Mr. Yakubu Dogara, intervened to rule that in view of the divergent opinions, the debate should be suspended.

The Inspector-General of Police, Ibrahim Idris, is expected to appear before the Senate on Wednesday (today). He will be grilled by the lawmakers on the arrest, detention and hospitalisation of Senator Dino Melaye.

The upper chamber of the National Assembly had last Wednesday summoned the police boss to brief senators the next day on Melaye’s case and the killings by armed herdsmen and militias across the country.
Idris however shunned the invitation, choosing to accompany President Muhammadu Buhari who was on a two-day visit to Bauchi State instead.
The lawmakers had declined to engage his representative, the Deputy Inspector-General of Police (Operations), Mr. Joshak Habila.
Miffed by his non-appearance, the Senate had resolved to reschedule the IG’s address to today.
In another development, the Senate Committee on Judiciary, Human Rights and Legal Matters is expected to present its report on Wednesday (today) on President Muhammadu Buhari’s approval of the payment of $496m out of the Excess Crude Account for the purchase of military aircraft.
The 12 Super Tucano aircraft ordered from the United States will be delivered in 2020.
The Senate had on Thursday resolved to refer the matter to the committee for legal advice, when lawmakers became divided on it.
The panel was given the mandate to investigate the circumstances surrounding the arms deal and whether the President violated the constitution or not.
Most of the lawmakers who spoke on the withdrawal and spending pointed out that the President had breached Section 80 of the 1999 Constitution, while a few disagreed.
Senator Mathew Uroghide, who is the Chairman of the Committee on Public Accounts, had specifically urged the President of the Senate, Bukola Saraki, to allow the chamber to invoke Section 143 of the 1999 Constitution against the President.
Uroghide had said, “There are serious consequences for the violation of our constitution. As a consequence, the only thing that we can draw from on this is that we call on you (Saraki) to invoke Section 143 of the 1999 Constitution. What it means is that this matter does not need to be investigated; it is clear that this offence has been committed by Mr. President.

“I want the Senate to resolve that what the President has done is procedurally wrong and it is a violation of our constitution. It must be condemned and, of course, the consequences that are contained in the constitution – in Section 143 – should be invoked.”
Saraki had last Wednesday read a letter from Buhari in which the President admitted that the money had been withdrawn and paid to the US ahead of legislative approval. This, Buhari said, was done to beat the deadline for the arms deal.
The President recalled that due to the “security emergencies” in the country, which was discussed with state governors, the National Economic Council on December 14, 2017, approved that up to $1bn be released and utilised from the Excess Crude Account to address the situation.
